Welcome to AdBuddy. These Terms of Service ("Terms") govern your access to and use of the website adbuddy.polsia.app ("Site") and all related services provided by AdBuddy ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Site, you confirm that you are at least 18 years old and legally able to enter into a binding agreement. If you do not agree to these Terms, do not access or use the Site. Your continued use of the Site constitutes your acceptance of these Terms.

2. Description of Service

AdBuddy provides an AI-powered ad generation platform that allows users to create advertising copy and image concepts for various online platforms. Our service uses OpenAI technology to generate content based on your input. We do not guarantee specific results, impressions, conversions, or any advertising performance outcomes.

3. User Accounts and Eligibility

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information and keep your information up to date. You must be at least 18 years old to use our service.

4. Acceptable Use

You agree NOT to use our service to:

• Generate content that is illegal, harmful, threatening, abusive, or discriminatory
• Create ads for prohibited goods or services (drugs, weapons, illegal activities)
• Infringe on the intellectual property rights of third parties
• Generate misleading, deceptive, or fraudulent advertising
• Spam or send unsolicited commercial messages
• Impersonate any person or entity
• Violate any applicable law or regulation in your jurisdiction

5. Intellectual Property

The Service and its original content, features, and functionality are owned by AdBuddy and its licensors. We do not claim ownership over content you generate using our service; however, you represent that you have all necessary rights to any content you submit. You are solely responsible for ensuring your ad content does not infringe third-party rights.

6. Payment and Billing

If you purchase paid services or products through AdBuddy, you agree to pay all applicable fees and charges. All payments are processed through Polsia's payment infrastructure and are subject to Polsia's payment terms.

Refund Policy:

• Starter (฿10/day): 7-day refund window from subscription start. After 7 days, no refund for the current billing period; cancel to stop future charges.
• Growth (฿30/day): 7-day refund window from subscription start. After 7 days, no refund for the current billing period; cancel to stop future charges.
• Pro (฿100/day): 7-day refund window from subscription start. After 7 days, no refund for the current billing period; cancel to stop future charges.

To request a refund within the 7-day window, contact us at adbuddy@polsia.app. After 7 days, no refund will be issued for the current billing period; you may cancel at any time to stop future charges.

7. Disclaimer of Warranties

THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, OR ERROR-FREE. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE EFFECTIVENESS, QUALITY, OR SUCCESS OF ANY ADVERTISING CAMPAIGN GENERATED THROUGH OUR SERVICE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AdBuddy SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICE, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify, defend, and hold harmless AdBuddy, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your use of the Site.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after any revisions become effective, you agree to be bound by the revised terms.

12. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. All provisions of these Terms which by their nature should survive termination shall survive termination.
